Estimate federal estate tax after preparing the estate's valuations, deductions, gifts and valid additional exclusion. Historical liabilities, property in another jurisdiction and estate income require separate review.

Kansas levies no estate or inheritance tax, but neighbouring Nebraska (inheritance tax) does. Real estate or tangible property located there can fall under that state's own rules and thresholds even when the owner was domiciled in Kansas: Nebraska inheritance tax calculator.

The primary-source rule for Kansas

Kansas Notice 10-07 says no estate tax is due for deaths from January 1, 2010 and the department will not process estate-tax returns for those estates. Older Kansas succession-tax or estate-tax schedules should not be used for a 2026 death.

Releasing Kansas personal property without a full probate

K.S.A. 59-1507b lets personal property be released to a successor by affidavit when the total probate assets of a Kansas resident do not exceed $75,000.

Nebraska inheritance tax reaches Nebraska real estate and the estates of Nebraska residents, so a Kansas family with property across the line should check it. Open the Nebraska worksheet.

Notice 10-07 says current estate returns are not processed

Kansas Revenue's notice addresses both payment and filing for deaths from January 1, 2010. That is an explicit department instruction, not a calculation based on an assumed exemption. An executor should not generate a Kansas estate-tax return simply because federal Form 706 is being prepared. The notice's death-date boundary should be recorded alongside the estate's identity and date documentation.

Older Kansas succession or estate forms can still appear in search results. Their thresholds do not create a current Kansas estate-tax bracket. If a notice concerns a pre-2010 death, review the original facts and ask the department about the outstanding matter rather than selecting 2026 in this calculator. Distribution timing cannot by itself move an earlier death into the current repeal period.

A Kansas resident's Nebraska land can require a separate Nebraska inheritance review. Keep the land valuation, ownership and intended beneficiary relationship available for that analysis. For the federal tool, approved deductions are entered directly; the worksheet does not assume that all liabilities in a probate inventory are deductible or that every beneficiary inherits the estate's net federal taxable value.
